Introduction
The paper that is about to be presented demonstrates existing proposals that regard in supplying Gloria Smithson’s company with necessary widgets. We will examine a couple of options that are appropriate for Mrs. Smithson’s case, even though supplying widgets from domestic suppliers is advised in most of the cases for a number of reasons. We are going to examine a proposal that is coming from the same state where Mrs. Smithson’s business is located as well as two more proposals from overseas. Each proposal is accompanies with strong features but contain drawbacks as well. We are going to analyze the features that give the best possible advice for our client from the proposals.
Proposals
Before making any choices, we are first going to check whether the proposals we have meet our client’s needs. There are four elements in order to consider any contract enforceable which are: agreement, consideration, contractual capacity, and lawful object. An agreement occurs when an offer comes from the offeror and an acceptance of this offer by the offeree; with mutual consent in mind. Consideration is something of value that is promised to be given; property, money, jewelry, and any values that meets equivalent value. Contract capacity is required for parties that enter into a contract. Minors and any person who is not in a state of consent cannot enter a contract because they are not able to consent properly. Lawful object cannot be illegal, immoral, and against common good.
Some requirements have to be looked at in order for it to be considered valid. These considerations must have an intention to make an agreement and come voluntarily to it. The offer has to be communicated to an offeree and the terms of the offer have to be concrete and unambiguous.
