Employment Compliance Laws

Many companies will have more than one location or offices in a city, state, country or more than one country and employment laws will be different between those locations.

Employment laws are established to protect, enforce and coordinate any labor relations between an employer and its employees. Starting from the hiring process any employer can discriminate based on gender, race, color, religion, political party, or national origin (Federal Civil Rights Act of 1964 (CRA)) or if any of the qualified applicants for an open position might have a physical or mental disability.

Any employee should receive a wage which is normally protected by federal or state law with its exceptions. Some states have different benefits for employees receiving minimum wage, an example is Texas that created an employer fund that provides benefits to pay medical bills and compensate them for a portion of his lost wages in case of an accident.

Federal law prohibits any kind of harassment between employees or between employee and employer, any repetitive or continued unwelcome conduct based on age, race, sex, color or disability can be considered harassment and a complaint should be filed against an employer for monetary damages.

Employment at will is normally a standard across most of the states or countries but in some case a resignation letter notice its required as part of the resignation process for an employee leaving any employer, in case this is not meet the employer can sue for any monetary damages. One example is Costa Rica; any employee on a permanent position leaving a company needs to file a resignation letter 30 days before his last day of employment with the current employer.

Any employee is entitled to request time off even if this time is unpaid, on some states specific events are covered by law, for example in Texas employees are entitled to 2 hours of paid time off to vote, or jury duty.
