The United States Congress should review current legislation and make changes to hold company executive accountable for the torts and frauds committed, rather than being protected by the corporation law and only pay fine without serving time in the jail.

We treat many people, whom we label as a “criminals,” as if they have no chance of forgiveness for their act against society, but yet we let many Big Bosses whose actions had a financial and emotional effect on people life’s, go free without any consequences for their actions. The reason we sent people to jail for life is because we assumed that if a person killed someone once, he/she is more likely to kill again. We think that teenagers who steal once should be charged with a crime and labeled for the rest of their life as a thief, simply because we believe that if no punishment will be made to them, then they will continue to steal. We think that people who sell drugs to the public should be taken off the streets and sent to prison, this way we believe that we are cleaning our streets from people who bring harm to society. We do not give them a second chance or try to educate them so they will not make the same choice next time. We live in the society that believes that people who commit a crime should pay for it with their assets, time, and in the worst case scenario with their lives. It is interesting that in the United States of America, when a corporation commits a crime against its shareholders, company executives are more likely to go free without any punishment.

One of the reasons why most executives go free without any punishment is because the US legislation treats a corporation as an artificial person. “This means that a company is treated as a separate person from its participants.” In case of lawsuits against the corporation, this regulation protects executives, and company owners, from loosing their personal assets and possible jail time.
