Good afternoon sir, my name is Gary Cannady and I am following up with you concerning the applicable laws that we must focus on for your new business, Landslide Limousine. Currently the Department of Labor (DOL) enforces more than 180 federal laws. In this memo, I will be introducing four of these laws that are important for you to know and the consequences for non-compliance.

The Fair Labor Standards Act (FLSA) has prescribed the minimum wage for covered non-exempt workers in Texas and many other states stands at $7.25 per hour effective July 24, 2009. The law states that in most cases, overtime (time and a half) must be paid to employees who work over 40 hours per week. Additionally, child labor laws regulate that children under the age of 18 are prohibited from doing some jobs and has special rules for the hours and times that they may work. There are two ways that employees can be covered under this law.

* The first way an employee can be covered is called “enterprise coverage” which states that in order to be eligible fit in the category of 1) working for a company having an annual dollar volume of sales or business done of at least $500,000 and 2) those described as hospitals, businesses providing medical or nursing care for residents, schools, or preschools and government agencies (www.dol.gov).

* The second way is known as “Individual coverage”. The eligibility for this coverage is “Even when there is no enterprise coverage, employees are protected by the FLSA if their work regularly involves them in commerce between States ("interstate commerce"). The FLSA covers individual workers who are "engaged in commerce or in the production of goods for commerce” (www.dol.gov).
