In this paper, I will be discussing the various elements of the video titled "You Be The Judge: Religious Discrimination.” The video describes the plaintiff, Adjha Djarra, being terminated for wearing her religious headscarf during the Islamic month of Ramadan. The defense, McFatty Burger Joint who is represented by the manager, Ralph Johnson claims that the termination was not based off of religious discrimination. Mr. Johnson claimed that she had repeatedly violated the company dress code in which he gave her plenty of time to correct but failed to do so. During this paper, we will analyze various issues that pertain to discrimination, causes of action, as well as the basis of the judge’s rule.
Firstly, we will analyze the religious discrimination and accommodation issues that were presented in this video. Ms. Djarra claimed that the fact that she could not wear her head scarf during the month of Ramadan was the primary reason of discrimination that was evident in her termination. Under Title VII, employers are not permitted to discharge an employee because of religion. Religion includes a sincerely held belief as well as all aspects of observance and practice of that belief (Rochelle, 2007). Since Ms. Djarra was not accommodated any other time for observance or moved to a different work station, she continued to work the front counter with her head scarf.
Next, we will analyze the different elements of the cause of action. According to Mr. Johnson, he felt the head scarf not only brought a discrepancy in uniformity, but he also felt threatened by the random customers who occasionally made hostile remarks towards Ms. Djarra. He also felt that this would lower the moral of the McFatty Burger workers as well as make everyone feel threatened by the customers.
