Views on the Canadian Independent Justice System

Some people may argue that the Canadian Independent Justice System is a threat to democracy and justice. Having judges rule courtrooms and make decisions based on their own knowledge may be one of the many reasons why some Canadians believe the system is a threat. However, this is not the case. Judges are appointed by the Prime Minister. It is a judge's job to make reasonable, just decisions when in the courtroom. Judges do have rules to follow. They are bound by and must uphold the Constitution and the Canadian Charter of Rights and Freedoms. Judges can not be intimidated by the threat of losing their position. Once appointed to the bench, they can only be removed if there is evidence of misconduct. Lastly, The Canadian Independent Justice System allows for a system of appeals. This system makes it possible for mistakes in the law to be dealt with appropriately. The Canadian Independent Justice System is not a threat to democracy and justice.

Judges are bound by and must uphold the Constitution and the Canadian Charter of Rights and Freedoms. Yes, judges make their decisions based on their own knowledge and experience, but they do that all while following the law. They cannot do whatever they please, they must make just decisions and the Justice System has higher courts to ensure they are doing so. If there is evidence of misconduct, the judge responsible would be removed from the bench.

The Justice System works in favor of society. An example of this is Robert Latimer's case, the father of Tracy Latimer. Tracy was born with cerebral palsy (due to an interruption of oxygen supply during birth) and Robert claimed that her treatments put her in much discomfort. He resorted to killing his daughter by carbon monoxide poisoning and was charged with second degree murder.
