Authority of the Court System: Federal and State.

The question is where the Federal and State courts receive their authority the answer to this question is that the Federal courts received their authority from our founding fathers of this country. Although they were not the first settlers here, they stole the country and then they wrote the Constitution of the United States. It is used even to this day. Although, because of some current events, the populous of the United States want to change the constitution so as not to allow the current president, (who we all know is a person of color), to appoint a replacement judge, to serve this country, as Judge Scalia did. It is hilarious how the blue bloods change rules midstream to suit themselves.

At any rate the Constitution is what would allow and give this current president, President Obama, the authority to make an appointment. The federal courts were established by the constitution to make decisions and resolutions to any of the disputes involving the Constitution of the United States. These sounds like it would be a long battle and extend far beyond his presidency.

The Judicial Act of 1789 is what places the court system as we know it into place. As of now it has changed very little. The president of the United States nominates the candidate and it is up to the Senate to confirm the nomination. When Clarence Barry-Austin was nominated by President Bush in 1991, after Thurgood Marshall announced his retirement, there were accusations brought up by Anita Hill that during her tenure working with him there was sexual harassment. It was the Senate responsibility to investigate before they accepted his nomination. They did just that and the rest is history.
