Delegation of Authority & Department of Homeland Security

Question 1 – Delegation of Authority: Based on your textbook reading, consider the following:

In what ways might a Congressional delegation of authority violate the Constitution? Congress might try to delegate too much of their power. They may also try to delegate their main functions of government. They may also try to delegate too much control over other branches of government.

Do you think the practice of delegating to quasi-government agencies presents special risks? Yes

Explain. In my opinion, when delegating to quasi-governmental agencies you are basically saying we are going to let you also take on the judicial authority also since we are not that interested in overseeing what you are planning on doing.

Question 2 – Department of Homeland Security: Go to the following website.

Then click on "Department Components" on the left. Click on several of the headings and get an idea of what authority the DHS has been given.

Then consider the following:

Comment on the structure of DHS and why it is set up this way. In my opinion, it looks like the DHS has control over all the major players when it comes to overseeing how our land could be a potential target again, Immigration and Naturalization is a no brainer along with the Coast Guard since some people do cross into the US illegally.

Also, is there anything you would change and why? I do not think I would change anything since it all seems to be working quite well as it is currently. It has been over 15 years since the attack on 9/11 if there was any kinks to work out I am sure the government would have figured them out by now.

Do you see any possible Constitutional issues with the delegation Congress has made to this agency? No
