APPLE VS SAMSUNG

SITUATION

Apple filed a complaint with the International Trade Commission, an independent federal agency. Their complaint was against arch-rivals Samsung. Apple was seeking to block Samsung from importing plethora of Galaxy electronic devices. That came after a week after Samsung also sought to stop imports of Apple’s popular iPads and iPhones. Samsung said in their statement it voted to institute an investigation into Apple’s claim and its request for a stop of mobile handsets. On the other hand Apple claims that certain electronic digital media devices and components are owned by them and Samsung claim Mobile electronic devices, including wireless communication devices, portable music and data processing devices.

CONCERN

The legal battle between Samsung electronics and Apple over smartphone and tablet patents will negatively impact the growth of the Korean company. Apple has already blocked the sale of Samsung tablets in Germany and Netherlands. Samsung’s tablet business will be most affected and its chip business will also take a hit as Apple moves to diversify away from Samsung to the likes of Toshiba. But taking passive steps for fear of losing its biggest customer will slow down strong growth momentum at its telecoms business, which Samsung doesn’t want to see as the business is set to become the biggest earnings generator this year and make up for weakening chip profits. Samsung and Apple’s products, products design and product user interface feature that copy of a combination of several elements of Apple’s registered trade dress. That result in causing confusion or to cause mistake and or to deceive the consumers as to affiliation, connection or association of Samsung with Apple. Customers they don’t know as to who the originator of the products is or who will services the products better if technical issues are encountered.
