1. Identify and explain at least three legal considerations.

One legal consideration for the hospital is that it has a contractual relationship with the patient. This is shown by acceptance of both parties who seek something from each other. On the hospital part they are expected to get paid for services rendered. At the same time the patient is expecting services that are of high quality and will not cause and harm.

The hospital corporation has the ultimate responsibility for the quality of care rendered within the organization. (Showalter, 2008) The medical staff shall be organized in accordance with written by-laws, rules and regulations, approved by the governing board. The by-laws, rules and regulations shall specifically provide ... (h) for consultation between medical staff members in complicated cases. . . . ( Illinois hospital licensing requirements, 1958)

Second consideration is that the services will benefit the patient. Both parties agree that the intellectual and understanding of hospital agents who act on the hospital behalf are practicing with the latest in procedural guidance and operate with care. In this case the hospital staffs are responsible for honoring the contract that is implied, in that all patient care would be continuous and appropriate. This case shows how uncontrollable circumstances can have impact on normal operations and staffs in Maryland staff are “at will” employees and can be fired at the discretion of the hospital

Thirdly, it is understood that the information that has been share for consideration of the relationship is truth without bias or contempt. This consideration asks the question are the services being suggested worth the patient agreeing to allow the hospital’s representative to act.
