Introduction

Over the course of many years the Juvenile Justice System has changed. The Juvenile Justice System started out by punishing children with death. Juveniles were tried in the same courts as adults. Later the Juvenile and the Adult Justice System was separated. Facilities were formed to help reform juveniles through prayer, work, and study. In these facilities the juveniles were punished with whips and were criticized for the abuse. The state took over the facilities and looked after the best interest of the juveniles. The Juveniles Justice System focuses on rehabilitation and not punishment. Juveniles were granted the same rights as adults in court. There became an increased awareness for public safety. During the waiver process the juvenile’s previous record is taken into consideration. The court looks at whether the juvenile would understand what they were being charged with and if they could understand the trial proceedings. When discussing Juvenile and Adult Justice Systems, one needs to consider the following punishment, and they are exploited in institutions.

History and Evolution of the Juvenile Justice System

The history of the Juvenile Justice System dates back to colonial times. Children as young as five could be treated as young adults or as property (Lives). Young children could sentence in criminal court. Children could be put to death for cursing at their parents. In 1825 juveniles and adult offenders were separated. Facilities were established to reform juveniles through prayer, study, and hard work (Lives). Juveniles were punished with whips.
