eBook Chapter 9, problem 6, page 313. Analyze Ms. Tom's case and respond to the question within the problem. Be sure to show the elements of the tort which Ms. Tom can allege and apply the facts to them. The case is not available on the internet, but there are cases which use it as precedent on the internet which will help you understand what the court did in this case. Practice doing internet research (using Google) to find a case which uses the Ms. Tom case as precedent. Submit your response to the Dropbox by the end of week 3.

I agree that is a foreseeable case, but nevertheless it is a very rare one. Who installed the unit? Was it someone from the store that he bought it from or was it the customer or someone else? It could've been just a pinhole causing leak. That's all it takes for the freon to leak out fairly quickly. I've seen heating/ac coils tested up to 500 psi and show no leaks. The unit could have been dropped during shipping or many things could have caused a pinhole leak in the tubing or a small rupture due to bent and/or damaged...
