STATEMENT OF THE UNION’S NATIONAL COUNCIL ON THE COLLECTIVE NEGOTIATION AGREEMENT INCENTIVE (CNAI)
CONTROVERSY AND OTHER PRESSING ISSUES THAT NEED TO BE
PROMPTLY AND DECISIVELY ADDRESSED BY THE MANAGEMENT
FOR THE COMMON GOOD OF THE AGENCY, ITS OFFICIALS AND EMPLOYEES
We the duly elected leaders of NIA employees all over the country strongly express our unequivocal positions on the following issues besetting the Agency at present, namely:
1.CNAI
We firmly believe that between MC 54 and MC 57, the former has a solid legal basis, which is the CNA between NIA and NIAEASP that is still in effect this year. On the contrary, MC 57 is patently illegal as it has no basis at all and directly contravenes Executive Order No. 7 issued by President Benigno C. Aquino III on September 8, 2010, which explicitly prohibits the grant of incentive without the approval of the president.
Along this line, we strongly denounce the proponents behind MC 57 for putting at risk the welfare of employees because of their glaring ignorance and negligence in pushing for the issuance of the above-cited MC despite the fact that the same is defective for lack of legal basis.
On the other hand, MC 54 is in consonance with NIA Board Resolution No. 7585-09, s. 2009, which is the foundation of the grant of CNAI for the past two years.
Although the Commission on Audit (COA) has issued Audit Observation Memoranda (AOM), suspension and disallowance of the CNAI in some offices, these COA actions are not sufficient reasons to hold in abeyance the payment of CNAI.
What these COA actions merely need are proper and right justifications duly supported by convincing arguments and legal bases that are thoroughly and comprehensively researched and studied. But sad to say, because of the gross negligence and inaction of few irresponsible officials at the Central Office (CO) who were assigned to prepare the required justifications within the prescribed period, the AOM on CNAI in Region 6...
