Sentencing Paper

1) The four philosophical reasons for sentencing criminals are retribution, deterrence, incapacitation, and rehabilitation. Retribution is a punishment imposed on a criminal that has committed a crime and is equal to the crime committed, deterrence is when the criminal is deterred from fear of further punishment by the courts and allows the general public potential offenders to be warned of the punishment, incapacitation is when a criminal cannot commit further crime, due to being detained and protects the public and society from crime, and rehabilitation’s purpose is to reform a criminals behavior to avoid criminal behavior in the near future.

2) The six forms of punishment are imprisonment, fines, capital punishment, restorative justice, probation, and restitution/community service. Imprisonment is a sentence given to a criminal for a serious crime they have committed and involves detaining the criminal in jail/prison and would include crimes such as murder, drug dealing, burglary, human trafficking, bodily harm, and robbery.

Fines are imposed as a monetary charge that is imposed on criminals who have been convicted or for a lesser charge. Capital punishment (also known as the death penalty) is done by the government, in which they plan to take criminal’s life because that criminal was involved in a crime and was legally convicted.

Restorative justice is repairing the harm that a criminal caused by his/her criminal behavior. The justice system does this by working to restore those that have been injured and individuals that were directly involved and affected by a crime will participate in the response and lastly it is the responsibility of the government to present public order and the responsibility of the community to build and maintain just peace.
