1.1 This statute in no way is fair to women, and is completely unconstitutional. We are an equal people; man, woman, white, black, we are all the same. For the state of Illinois to enact a law in which women are limited on their hours of work it outrageous. After reading the actual statute you begin to realize how they actually felt about women, that they were all weak and frail. Of course we know now that this is completely untrue, and that this law would never be enacted today. We have had women CEO’s, women construction workers, etc, working their hardest to be the best for the company, and owning their OWN companies. If the State legislature of Illinois saw how far the women population has gone since then, they would be thoroughly surprised. Yes, Law can be seen as a progressive science. It is a constantly changing science.

1.2 I personally think that the decision to only draft men into the military is fair to an extent, and this law wouldn’t be considered progressive. First, drafting men only has been a tradition since the beginning of any military’s existence. Second, because as the court states “Men and women are simply not similarly situated for purposes of a draft or registration for a draft.” The court seemed to see that women wouldn’t be put right in the middle of the battle, and that if they wanted to join they would on their own.
