Scenario 1

The First defendant I see in this case is the owners of the football stadium for negligence. The owners of the stadium breached the duty of care by not having a safety net in place in case of incidences of an object getting thrown into the crowd. Football in not known for objects get thrown into the stands but there are some cases. “For instance, the Pennsylvania Supreme Court in Jones found that a defendant can be held negligent for an injury not common or frequent to a game, and therefore the no- duty rule only applies to expected risks” (Khare, 2010 P.2). In this case there was a duty of care to the plaintiff, breach of that care, injury, and the defendant’s negligent act was the proximate cause of the plaintiff’s injuries (Cheeseman, 2010).

The next defendant in this case is going to be Daniel for committing an intentional tort. Daniel Shoving Malik causing him to fall and hitting his face on the steps knocking out two of his front teeth. This intentional tort is called battery because it is unauthorized and harmful physical contact to another person (Cheeseman, 2010). Out of anger Daniel push Malik causing him physical harm that falls under the intentional tort laws, and this is why Daniel will be the defendant.

The defendant in this case would be the owner because Malik injured himself on his or her property. The owner has a duty of care to the spectators to provide safe conditions. The owner showed negligence by not maintaining the stadium and did not show duty of care to the spectators. The railing should not have broken from the fall, and the owner should be responsible for the damages.

The potential defendant would be Daniel’s boss because Daniel could sue his boss for wrongful termination. Daniel’s boss breached his contract because he did not have the right to fired Daniel for something not work related. Daniel’s boss stated that he does not want anyone working for him who would give alcohol to a child, and that Daniel was fired....
