Employment Act 1955

Employment Act examine the relationship between workers and their employers within the working environment.

First and foremost, it provide the legislative framework for the system of industial relations. Secondly it outline the rights and obligations of the parties at the work place. The rights and obligations of employers and employees differ depending upon whether the workers belong to a trade union or not. However, the employment laws lay down provisions which affect not only unionized workers but all employees. Some of the laws clarify the rights of trade unions and employers whose workers are unionized and others set down minumum welfare provisions which apply all workers, whether unionized or not.

We have chosen the company Sidenco Engineering and Construction Sdn. Bhd. as example of employment law that they have been practising. According to this company, it is vital to outline the procedure and policy on employment to ensure all employees are informed of the status and the progress of the company.

One of the employment procedure is recruitment. It is one of the most vital features of employment and all job applicants are matched against the comprehensive job specification during the job interview process.

Secondly is regarding the working hours. It is divided into two which are working hours for head office and site office. For head office, they are required to work from Monday to Friday. Specifically, they start working from 9 a.m. to 6 p.m. They are given lunch an hour of lunch break which start from 1 p.m. to 2 p.m. On Friday, all the employees especially male Muslim employees are given extra 30 minutes break (1 p.m. – 2.30 p.m.) for them to perform their Friday prayer. As for the site office, they are required to work from Monday untill Saturday starting 8 a.m. to 5 p.m.
