Yes, BUGusa can sue WIRETIME for Trade Libel. Because WIRETIME is a competitor and they made a public statement that ridiculed BUGusa product they committed a Trade Libel tort.

Scenario: WIRETIME, Inc. (Janet)

Has WIRETIME, Inc. committed any torts? If so, explain.

Yes, WIRETIME committed a tort of Tortious Interference with Existing Contractual Relationship. Many courts would consider holding WIRETIME liable for BUGusa’s damages because BUGusa was injured as a result of WIRETIME’s tortious interference with the BUGusa-Janet contract. BUGusa would also be entitled to recover damages from Janet for breaking the contract.
