Court History and Purpose Paper

The primary function of any court system – to help keep domestic peace – is so obvious that it is rarely considered or mentioned. If there were no institution that was accepted by the citizens of a society as an impartial and authoritative judge of whether a person had committed a crime and, if so, what type of punishment should be meted out, vigilantes offended by the person’s conduct might well take the law into their own hands and proceed to punish the alleged miscreant according to their uncontrolled discretion.

Court and Purpose

A court is an institution that the government sets ups to settle disputes through a legal process. People come to court to resolve their disagreements. The courts decide what really happened and what should be done about it. They decide whether a person committed a crime and what the punishment should be. They also provide a peaceful way to decide private disputes that people cannot resolve themselves. The courts use the adversary process to help them reach a decision. Through this process, each side presents its most persuasive arguments to the “fact finder” and emphasized the facts that support its case.

The purpose of the court is that is operates in a fairly standard state judicial structure. The court functions as a middle ground between minor and appellate courts, handling several case types in different states.

Dual court system

The dual court system is the distinction of state and federal courts that make up the judicial branch of government. Where a case does not involve the government or multiple states, the state court has been assigned jurisdiction as stated in the United States Constitution. There has been some talk of court unification at different points over the last century, but it has not taken place universally.
