Political Analysis

Previously, since 1962 Myanmar was under strict Military regime control. The military junta strictly controlled in every aspects of the society from strict rules to the public. Economically, the government surpassed from the market to a more controlling socialized system where as resources were owned solely by the government and productions were made by the public under permission from the government. Therefore, it is classified as ‘extreme’ risk country. The exchange rate of Myanmar’s Kyat to Thai Baht is 1 Kyat is equal to 4.81 baht which is not really high and would not really affect much in exchange goods between two countries. Myanmar also established one free trade agreement e.g. ASEAN with Thailand which leads to low tariff and non-tariff barriers when exporting and importing.

Recently, the government has developed towards a more democratic political system and ease rules and regulations. The first election with a civilian government in two decades is formed. Though the social control are being eased and citizens are more involved in politics but the military still holds significance power and influence in the government. However, this would still benefit trades and the economy since the government favors trade and foreign investments and is being more open to.

Regarding Intellectual Property rights, there several existing laws such follows; The Penal Code, the Myanmar Patent and Design Acts 1946, The Myanmar Copyright Act, the Myanmar Merchandise Act, the Registration Act, the Specific Relief Act. Myanmar has no specific rules regarding trademark but a written definition was given as follow in the Penal Code section 478:

Trade mark can be registered at the Office of the Registrar of Deeds and declared as a Registration Act published publicly on Medias.

Copyrights Act was declared in 1914 but in practice the court has no experience in copyright case which mostly these cases will be settled by the arguing parties based on...
