Domestic Gas: Health and Safety Law

Gas health and safety law aims to ensure the safe installation, maintenance and use of gas in domestic and business premises.

The Health and Safety Executive (HSE) and local authorities have joint enforcement responsibilities under the Gas Safety (Installation and Use) Regulations 1998 to aim to prevent injury to consumers and the public from either carbon monoxide (CO) poisoning or fire and explosion.

The Gas Safety (Installation and Use) Regulations 1998 place responsibilities on a wide range of people, particularly:

Landlords

In relation to domestic gas under the Gas Safety (Installation and Use) Regulations 1998 a landlord is anyone who rents out a property that they own under a lease that is shorter than 7 years or under a licence.

Landlords' duties apply to a wide range of accommodation, occupied under a lease or licence, which includes, but not exclusively:

* Residential premises provided for rent by local authorities, housing associations, private sector landlords, housing co-operatives and hostels.

Landlords must arrange maintenance by a Gas Safe Registered Engineer for all pipework, appliances and flues, which they own and have provided for their tenants use.

Landlords must also arrange for an annual gas safety check to be carried out every 12 months by a Gas Safe Registered Engineer.

 

Landlords must keep a record of the safety check for 2 years and issue a copy to each existing tenant within 28 days of the check being completed and issue a copy to any new tenants before they move in.

The Gas Safety (Installation and Use) Regulations state that landlords must only use Gas Safe Registered Engineers for maintenance and safety checks on gas equipment they own and provide for...
