Question #1

The process of establishing a bargaining unit in the workplace can begin with as little as one worker. That single worker begins gathering other employees that have a community interest. This means that those wanting to be in the bargaining unit have similar wages, hours, working rule, and conditions. The community interest is what determines which bargaining unit the organizers are attempting to establish. The organizing members begin petitioning and gather authorization signatures. After collecting at least authorizing signatures from at least 30% of the workers that would be affected by the bargaining unit the organizing group sends RC petition to the National Labor Relations Board.

The regional director reviews the appropriateness of the selected bargaining unit and reviews the list of eligible employees submitted by the employer to determine if the organizing group truly has 30% authorization. Once reviewed NLRB determines whether an election is to be conducted and schedules the secret election if required.

A secret election is held at the employer where all employees that would effected by the unionization vote on whether they want to be unionized. In order to become unionized the proposed bargaining unit must have a majority vote. Upon completion of the election the NLRB determine the validity of the election ensuring that employees had a free choice in the vote.
