The CEO and Board members of Kardell Paper Co. after testing was completed by a student researcher and a report compiled by the assistant production manager was advised to put in place a new process/technique to recycle waste water to reduce the output of an industrial chemical called sonox.

Legally there isn’t sufficient proof that will place Kardell as the sole reason or producer of sonox that is found in the Cherokee River which is making some residents of the Riverside community ill. As it is Kardell is properly observing all existing regulations on emission levels, so before making any changes the proposition will be to wait until the government has established an acceptable limit for sonox emissions. Residents who have become ill have already brought liability actions against 2 other companies but the charges have been dismissed owing to lack of direct evidence that proves that sonox is a health hazard.

The proposed solution would be beneficial in the long-term because of the cost-effectiveness but short-term it will have the plant operating at reduced capacity levels for about a year and Kardell stands a chance of having to close for an additional year to make the changes go into effect. To avoid this short-term loss Kardell should continue operating as it is because legally the company cannot be found guilty of any charges contributing to the residents becoming ill thus no settlement or payout will be made to the residents that will cause a loss to the business.

The legal team stands by this decision and is confident that we are abiding by all the laws set in place to win or have dismissed any lawsuit brought against the company.
