I carefully researched the most important requirement for Billy to sponsor Jane. I have few questions for Billy before we go any further. I believe the immigration will have similar questions which I have written below.

* Can Billy prove to the US immigration that he can provide stable accommodation for Jane?

* Billy needs to prove that he is employed and working fulltime.

* Is Billy willing to show his income tax to the immigration, for the past 5 years?

* Since Jane is a minor and she cannot file for asylum until she is 21 years of age, can Billy ask to be her guardian from her parents?

* Since Jane is a minor can Billy provide schooling for her?

* Board and lodging is a must for Jane, Can Billy provide this all by himself?

If Billy signs this contract to sponsor Jane, must show that she/he has income and/or assets that place her and him at or above 125 percent of the federal poverty guidelines for her/his household

Billy has the right to petition for Jane as she is his niece. Bill is 21 years old, and any one in US who is 21 can sponsor their immediate family or any other family. Since Jane is not immediate family, it is going to take more time than immediate family to receive asylum.

Jane is a minor and Billy is not Jane’s guardian therefore he will get a roadblock when processing his petition. Jain’s parents are still alive and since there are no papers signed to transfer the guardianship, Jane will have a difficult time gaining an asylum in United States.
