Apple, the Beatles' record company, is suing Apple the computer company -- again

Who knew a common fruit could become so contentious? Apple, the computer company, was in a London court last week, pursued by Apple, the Beatles' record company. It's the third time the two have faced off in court, and this time it's a classic case of advances in technology overrunning agreements struck in an earlier era. At issue is downloaded digital music and the Apple logo and name.

In 1980, way back in the days when vinyl still ruled, George Harrison noticed an apple in an ad for computers. He figured it might contravene the Fab Four's shiny green Granny Smith trademark. It took a year of legal toing and froing, but in 1981, Apple Computer, then a Silicon Valley start-up headed by the relatively unknown Steve Jobs, agreed to stay out of the music business. All was well, for almost a decade. Then, as software became available that allowed Macintosh computers to synthesize sound, the trademark dispute erupted once again, as the record company returned to court to sue the computer company. This time, as part of a settlement reached out of court in 1991, Apple Computer agreed to pay $26.5 million to Apple Corps, the company formed in 1968 to oversee the Beatles' business interests.
