White Collar Criminals: Are They Immune from Justice?

* Introduction

The concept of white collar criminality is radically different from the usual concept of crimes. This type of criminality proves harmful for the social interest sometimes indirectly or sometimes with tremendous consequence. Persons committing the “white collar crime” affluent and well established in their social and, economical and occupational life in such an extent that many people don’t want to certify them as criminals and crimes committed from their sides are not approved as crime from many people. It is the crime of elite class people who are professionally very skilled and affluent and also socially much respected.

* What white collar criminal is?

White collar crime, as Sutherland states, is “A violation of the criminal law by the person of upper socio-economic class in the course of his occupational activities“. This includes –

i. The branch of trust.

ii. Misinterpretation of the financial statements of corporations.

iii. Manipulation of the stock exchange.

iv. The bribery of the public officials to secure desirable contracts or immunities

v. Bribery in commercial transaction.

vi. Misrepresentation in advertising and salesmanship.

vii. Embezzlement and misuse of trust funds.

viii. Dishonest bankruptcies.

ix. Copying of trademark.

x. Theft of the copyrights.

xi. Making false statements regarding the income of individuals or corporations.

xii. Non-payment of tax.

In a word we can say that “White Collar Crime” is the “crime of the decent or gentlemen” of the society.

“A variety of nonviolent financial crimes, generally committed by businesspeople or public officials, involving commercial fraud, consumer fraud, swindles, insider trading on the stock market, embezzlement, bribery, or other dishonest schemes.” (Nolo’s Plain-English Law Dictionary)
