Case of Bristol Tramways & Fiat Motors

Bristol Tramways entered into two contracts with the Fiat Motors for the purchase of vehicles. Both the contracts were in writing through letters signed by the manager of the Bristol Tramway company. It was made known to the Fiat Motors that the vehicles were needed for the conveyance of the passengers in and near Bristol, a heavy traffic area in hilly district. The vehicle broke down on use and become useless. There was no express contract of warranty. Bristol Tramways had relied on the skill and judgment of the company. Also, their managers had visited the company to see the vehicles. Thus arose the question of the responsibility of Fiat.
