THESIS OF THE ARTICLE:
The March 8, 2010 edition of Time magazine had a story titled “Give Me Your Tired, Your Poor, Your Huddled Masses Yearning to Homeschool” (Moore, 2010, p. 47). The article focuses on the Romeikes, a family of 7 who fled their native Germany because German law prohibits homeschooling (Moore, 2010, p. 47). At the prompting of the Virginia based Home School Legal Defense Association (HSLDA) the family relocated to Morristown, Tenn., where they applied for and were granted political asylum (Moore, 2010, p. 47-48). The federal government of the United States is expected to appeal, because Germany is a close ally of the U.S. and also because political asylum is usually granted for dire circumstances, and only very rarely to a citizen of a Western country (Moore, 2010, p. 48).
CRITICAL ANALYSIS OF THE ARTICLE:
The United States is committed to the ideal that no foreign national will be returned to a home country where his life or freedom is threatened (Wasem, 2005, p. 1). The Immigration and Nationality Act (INA) of 1952 states that aliens seeking asylum must prove that if they are returned home, they will be persecuted based on their race, religion, nationality, membership in a particular social group, or political opinion. In 1968, the United States agreed to be part of the 1967 United Nations Protocol Relating to the Status of Refugees (Wasem, 2005 p. 3). This protocol demands that participants give rights and protections to those individuals who meet the definition of refugee (Wasem, 2005, p. 3). The Refugee Act of 1980 “codified the U.N. Refugee Protocol’s

definition of a refugee in the INA” and established uniform procedures for the treatment of aliens within the U.S. (Wasem, 2005, p. 3).
