Jurisprudential Theories

Over the years, the legal system has undergone a number of changes which includes application and implementation of laws. An appellant's case may have more than one argument, but it is the judge’s duty to settle on a decision, basing on the numerous jurisprudence theories presented in law (Delaney, 109). The judge has a duty to act in accordance with the constitution, which is the supreme law in any nation. Decisions contrary to the constitution are considered null and void. In America, the Supreme Court is mandated to interpret the constitution or controversial statutes, which create misunderstanding between defense and accused parties in a dispute. The case presented in this paper involves misinterpretation of the Freedonia Antidiscrimination and Employment Act. In the District Court case, Sally vs. Clueless Co. The judge ruled in favor of the company. The judge acknowledged that Sally was sexually harassed by her former employer, but the law did not guarantee compensation for any employee who resigns, due to this allegation. The act states that employers ought not to discriminate their employees on the basis natural appearances, which is beyond their control. Natural appearance includes; sex, color and race. The District court judge found it appropriate to rule the case in favor of the employer basing on the Employment Act.

The Antidiscrimination Employment Act addressed employment terms, promotions, rewards and benefits applicable to an employee in any organization. Sally was sexually harassed and voluntarily resigned from her job to protect her dignity through the legal system. Her case found its way into the Supreme Court for hearing and determination. Apparently, it is the first case of this nature to reach the Supreme Court. Its decision will determine future rulings in Freedonia.
