1. What was the legal issue in this case? What did the court decide?

The legal issues in this case are whether or not a number of female applicants were subjected to sexual discrimination under Title VII of the Civil Rights Act of 1964 by The Dial Corporation. The court ruled in favor of the employees, stating that Dial’s use of a pre-employment strength test was unlawful and had a distinct impact on the female applicants.

2. What is the evidence that use of the strength test disadvantaged women?

The fact that for three years prior to the institution of the Work Tolerance Screen (WTS), 46% of the Dial’s new hires were women but after the test, the women hired dropped to only 15% (Walsh, 2013). These factual data elements were evidence that use of the strength test roved to be a disadvantaged women.
