Apple vs Samsung - US Battle

Apple, Inc. against Samsung Electronics Co., Ltd.

Appeal from the United States District Court for the Northern District of California in Case No. 11-CV-1846, Judge Lucy H. Koh.

Case Facts:

This case consists in a suit introduced by Apple, Inc. on April 15, 2011 against Samsung Electronics Co., Ltd., Samsung Electronics America, Inc., and Samsung Telecommunications

America, LLC.

Apple argues that Samsung is infringing Apple’s patents related with the design and utilities of the cellphones and tablets. The patents in discussion were:

* D’677 - Back part of the device.

* ’381 - Bounce- Back Effect

Two months later Apple added another claim for other patents:

* D’087 - Home button, rounded corners, tapered edges

* D’889 - Ipad’s ornamental design.

On July 1, 2011, Apple presented an order to restrain the importation and sale within the United States of the Samsung devices in dispute, this order was denied, because the plaintiff did not satisfied its burden of demonstrating an abuse of discretion. However for the D’889 patent the circuit of judges found a fault in the decision of the district court and the injunction was remanded.

Apple introduced a lawsuit against Samsung in the California Court, because Apple argues that Samsung is copying different patents registered by Apple in terms of design and utilities, and Apple is requiring a restriction in the importation and sales of the Samsung devices.
