Module 1: Writing Assignment

1) A case involving an appeal of a zoning board's decision to limit the number of adult book stores on any single city block.

a. The first amendment would be considered in this, the store has the right to sale adult magazines. I do believe that there is not a need to have so many on one block, but if the county will and the government will allow it; then I don’t see why it would be a problem. The citizens that don’t invest in those magazines may have a problem with it, but for the ones who buy them it is a way for the government and county to make some money and please there citizens.

2) A case involving the constitutionality of an abortion statute.

3) A libel case against a small town newspaper involving allegations of the mayor's dishonesty.

4) A case involving the distribution of antiwar flyers at a private shopping mall.

b. Amendment 1 gives the people the right to freedom of speech, but due to the fact that this shopping mall was private gives the mall the right not to allow the protestors to give out flyers to the customers. If the anti-war flyers were to be disturbed in a public place that wouldn’t cause any confusion, then that would probably be fine.

5) A case involving the search of a high school student's locker without her permission.

c. I do feel that now and day’s school should be allowed to search children’s lockers ONLY if there is a reasonable cause. Now and days children are bring guns, drugs, and other illegal items to school; which are causing death, injuries, etc. I do believe that if a child is being suspected of doing something illegal on the property the school administration should have the right to search the student and any property they own. Amendment 4 states that the government can search and seizure by probable cause.
