Factories Act vsBuilding and Constructions Work Act (BOCW)

The Factories Act, 1948

It has been established to provide safety measures and to promote the health and welfare of the workers employed in factories. State Governments/Union Territory Administrations have been empowered under certain provisions of this Act, to make rules, to give effect to the objects and the scheme of the Act.

• This Act applies to factories, which qualify the definition of “Factory” under the section 2(m) of the Act or to those industrial establishments, to whom section 85 have been made applicable by the State Government, by notification in the Official Gazette.

• This applies to any premises wherein 10 or more persons with the aid of power or wherein 20 or more workers without aid of power are/were working on any day in the preceding 12 months, wherein manufacturing process is being carried on.

BOCW

An Act to regulate the employment and conditions of service of building and other construction workers and to provide for their safety, health and welfare measure and for other matter connected therewith or incidental thereto.

• This Act may be called the Building and Other Construction Workers (Regulation of Employment. And Conditions of Service) Act, 1996.

• It extends to the whole of India and came into force on the 1st day of March, 1996.

• It applies to every establishment which employs, or had employed on any day of the preceding twelve months, ten or more building workers in any building or other construction work.

Difference on the basis of welfare services provided:

Factories Act BOCW

Applicability It is applicable for all factory establishments. This act is applicable specifically for the construction workers.

Welfare Factories Act focuses at the health and working conditions of the worker. BOCW focuses at the monetary conditions of the worker.
