2326 Vic st. has had leaks in the roof for months. We’re assuming even before we moved in, since the living room ceiling tiles have been stained since then and occasionally have even leaked onto our couch.

Ed came out in the winter to look at the living room ceiling and said there was a gap between the bay window roof and the house siding. At the time he wasn’t able to fix it due to ice on the roof. Since then nothing has been done on your part.

One of the bedroom ceilings started leaking towards the end of last month. The tenant of the room called you and left numerous messages about it and you called back a few days later and said Ed would come out and fix it. He did come out later that week and said he didn’t have a tall enough ladder to fix the leak in the roof. Nothing was heard from him or you for a few weeks until he came out and tore down half of the ceiling and the wall. Since then, which was over a week ago, no tenants in this house have heard anything, and now the room below is beginning to have water stains on the ceiling.

An inspector came out on May 9th and “Observed several areas of water damage and stained ceiling tiles throughout”. The notice was sent to you and was forwarded to our house. It claimed that you had to “remove all visible mold and make any necessary alterations to existing conditions in the premise which may contribute to the growth of mold (e.g. water leaks)” within 5 days. This means that by the 15th these fixes should have been completed. Currently it’s the 26th and nothing has been done except tearing down half of a ceiling.

If these changes do not take place by the first of the month, 5 days from now, the rent of the tenants of 2326 Victor St. will be put in escrow with the court of Cincinnati. A written notice of 30 days does not take affect here because of the inspection by the health department saying to get rid of the mold and water leaks within 5 days. This happened on the 10th.
