1. Explain whether Jake’s actions are in or out of “his scope of employment".

The actions that Jake where displayed where within scope of the employment description as a service manager. Having the role as manager, Jake must conform to the daily activity of meeting the daily quota, as well as, maintaining order within the department insuring output expectations. Jake went communicate with Herman about the injury that had occurred while working on the vehicles. That was the first correct step in a possible worker comp. case that Jake could have with the job. Herman was notified by Jake about the reason for the many vehicles being back-up in front of the vehicle service entrance. The scope of Herman job description must state that a vehicle mechanic must to a thorough check of any vehicle that may come under their care. The reason for the thorough check is to insure that all mechanical part associated with the vehicle are in proper working condition to insure the safety of the driver, pedestrians and other fellow motorcar operators.

2. Explain whether or not Herman is responsible for Jake’s injury.

Actually, Herman as an individual is not responsible for the injury that Jake sustained, but as his employer they are bound to the states workers compensation laws in which Jake and all of their employees should be insured under. This employer funded compensation allows all of Jakes medical expenses incurred from the injury to be expense towards the company’s insurance policy.

Workers are protected by laws developed by state and federal legislators. These laws allow any worker under the umbrella to defeat possible contributory negligent assumptions with without prejudice. This means that all workers have the right to receive compensation due to the set agreement between the employer and employee, in case of possible non-intentional on the job injury.
