The job of the negotiator is to build credibility with the "other side," find some common ground (shared interests), learn the opposing position, and share information that will persuade the "other side" to agree to an outcome. As an agent town representative this is what I know, about record contracts, record labels pay two royalties: The first is a record royalty to the performing artist(s); the second is a mechanical royalty to composers and publishers.

Companies pay anywhere from eight to 16% percent on royalties, the packaging can be anywhere from 15 to 25 %. Many other companies base their price on the wholesale price given to distributors. The breakdown would require that for a CD costing $16.98 the deduction for packaging would be around $4.25 with the remaining cost being paid to the artist.

My clients want to get an increase in their pay, as a fair offer we would like to obtain 15% as an average for all band members. I believe with the calculated sales from their songs and listener reviews and ratings this is a fair offer for all parties involved.
