REFLECTION: COMPARISON BETWEEN AUSTRALIAN LAW AND MALAYSIAN LAW
BRIEF INTRODUCTION:
Malaysian law and Australian law share the same law system which is the “Parliamentary system “ which is commonly known as the Westminster System A1. These two countries happen to practice the same law-making process as result of being ruled by the British . For Malaysia, it was between the year 1895 as toward it’s independence day in 1957 till the present day. Whereas for Australia, in 1788, the Westminster system was brought by the British to Australia which was divided into Judge made law and Parliamentary law.
This reflection is a brief comparison of Australian Law with Malaysia Law and reason for which would be least complex.
LAW-MAKING PROCESS (PARLIAMENTARY):
Laws made by the Parliament are called statuesA2. The Australian Parliament is divided into two separate chambers which are the Senates(Upper House) and the House of Representatives(Lower House). When combined, these two houses , create legislation regarding State, and Federal issues such as : Banking, Taxation, Environment Law, Roads, Public Transportation, and Schools .In order for such acts to be uphold, the Minister is responsible for bringing the ideas to the Cabinet which are drafted in form of bills. These bills would be drafted by a the Office of Parliamentary Council through thorough investigation of these ideas which have been brought by the Minister form the committee . Hence , these bills would be brought forth to the legislation assemblyA1. All legislations ( bills ) would be discussed by both Upper and Lower houses and be given Royal Assent by the Queen’s representative; the Governor before it becomes an act of ParliamentA1. All Bills are read and introduced in the legislative assembly. There are three stages of the reading of the bills. The First reading is where the bill is introduced to the Legislative assembly(A20).
