Yusef Ali parked hi automobile in a parking lot owned by the Dumas Corporation and leave the keys to the parking lot attendant and get a receipt for the payment of the parking fee. This is bailment and the vehicle is a chattel. Parking lot attendant have to do reasonable take care of the vehicle.

The attendant close the parking lot and Ali wasn’t know about that and the attendant took all the keys to the other parking lot which open’s till 2:00 and this parking lot is also owned by Dumas corporation. When Ali came back and he discovered that his vehicle wasn’t there and he report for the missing vehicle. Police found his vehicle in other part of the city and the vehicle had been damaged and stripped.

Ali is the bailor and the attendant is the bailee and the bailor could sue the bailee for not doing the proper take care of the vehicle. The vehicle got stolen after the parking lot close and Ali should know about closing time and the bailee can raise this issue and Ali might be responsiable for the damages. There another thing that when the attendant close the parking lot he took all the keys to the other parking lot, so the attendant didn’t do any negligence. When Ali pay for the ticket there was condition there on the back of the ticket that the Dumas Corporation is not responsible for any lost/damages.

The bailee did proper take care of the vehicle till the parking lot close and when it close he took all the keys to the other parking lot which mean he wasn’t negligence and there was condition on the parking ticket that they are not responsible for any damages, so the bailee is not responsible for the damages. The bailor has to pay for the damages.
