WIRETIME has committed an intentional business related tort known as Defamation. In this instance all four elements of defamation are present. A defamatory statement was made, it was disseminated to a third party, the statement was very specific to one company, and it caused damages to BUGSusa clientele.

Scenario: WIRETIME, Inc. (Janet)

Has WIRETIME, Inc. committed any torts? If so, explain.

In this instance, WIRETIME has committed a Tortious Interference with Existing Contractual Relationship Tort. WIRETIME had induced Janet to break the existing contract with BUGSusa for their employment. WIRETIME had specific knowledge of and physically saw the contract. They actively interfered with the contract and caused losses to due to training a replacement for Janet.

Scenario: WIRETIME, Inc. (Steve and Walter)

Discuss any liability BUGusa, Inc., may have for Walter’s actions.

The type of liability to BUGSusa in this incident is called Scope of employment. In this instance, the security guard committed the tort of False Imprisonment on Steve. Although Steve was not acting accordingly, neither was Walter due to the fine line of limited detention. Walter was acting in accordance with his duties of employment for the false imprisonment. It occurred within the compounds of the business, and was motivated by a purpose to service BUGSusa.
