INTRODUCTION TO THE SOURCES OF LAW
1. Learning Objectives:
The aim of this topic is to enable students to:
• Show a basic understanding of law and the Malaysian Legal System
• Apply the substantive knowledge of legal system by citing cases and relevant statutes
2. Learning Outcome:
A successful student will be able to:
• Explain briefly about the Malaysian Legal System
• List down the sources of Malaysian Law
• Tell the differences between:
➢ Written and Unwritten laws
➢ English Common Law and Equity
WHAT IS LAW?
• Derived from customary practices of society
• Law consists of rules recognized and acted on by courts of justice
• Body of rules which are enforced by the state
• Society to be bound by and follow the rules laid down
• Its aim is to attain justice and regulate the society towards achieving the same goal
LAW IN THE STUDY OF BUSINESS
• People involved in business needs to have a reasonable grasp of relevant areas of law for the purposes of ensuring that the business stays within the law
• If not it can lead to costly claims being made against the business
• Eg: If you wrongfully dismissed your employee not knowing the rules protecting the employee under the Employment Law, you will have to pay a high compensation to him. Eventually it will also lead to the damage of the reputation of your business
• Eg: Also helps you to take all reasonable steps to avoid your clients/customers from taking any actions against you under the Consumer Protection Act 1999
