Dear Mr. Jim Knott:

RE: Jim Knott v Cindy Tank

I am contacting you to go over what you may expect during this lawsuit process. Should you choose our firm we will first start with filing a petition or complaint. You as our client will be the plaintiff in the complaint and during this process a summons and a copy of the complaint will be delivered by a service processor to the defendant - Cindy Tank, Sunshine Tank Supplies, Incorporated, 5678 38th NE, Kennewick, Florida 25539 and her legal team - Bill Bold of Early, Bold & Help, 3432 Apple St, Bellevue, Florida 25519. An affidavit of service will confirm delivery of the summons. In some cases if the respondent/defendant don’t respond to the complaint in a timely matter the plaintiff could be awarded a default judgment. The defendant can also file a counter claim, which is a claim against the plaintiff as well. Should any changes need to be made to the original pleadings we can file a motion to amend or pleading. The respondent/defendant may also file motions also including a motion to dismiss (throw out the complaint) or a motion for summary judgment.

The next stage is the discovery stage, which includes depositions (formal questioning setting with court reporter and is under oath), interrogatories (written form of questions to be answered by opposing counsel in writing), and production of documents this process is for the parties to collect evidence.

Pretrial hearings are held after discovery to insure that there is less disruption during the process of the trial. During this process the attorneys my file motions to exclude certain evidence. This will not be in the presents of a jury.
