Law Opinion Paper

The United States’ democratic government is governed by laws that are introduced by public officials. The United States has a legal system that has three branches to have a division between federal and state law. The three branches of government are legislative, executive, and judiciary which all play a role in the legal system and the creation of laws. The branches of government were put into place to create a system of checks and balances. The branches work together because no single branch of government can act freely based on its own will. The laws and practices of the United States were created based on the foundations of English common law. Also there are many factors that lawmakers must consider and acknowledge before writing laws to be reviewed and executed.

The legislative branch was established by Article I of the constitution. It consists of the House of Representatives and the Senate. The constitution gives this branch the authority to pass legislation. Once the legislation is passed they send it to the President to be signed. The bill must pass in the Senate and the House with majority vote. If the bill gets two thirds majority vote once passed through the House and the Senate, it can be overridden even though the President may have vetoed it.

The executive branch includes the President of the United States who acts as the head of state and the commander-in-chief of the armed forces. The executive branch is the branch of government that governs the law enforcement agencies. The President is responsible for appointing the Cabinet; which is responsible for day-to-day enforcement and administration of federal laws. The judicial branch differs from the other branches because the other two consist of elected officials and the judiciary branch consist of people appointed by the President and then are confirmed by the Senate.
