Law and legal concepts training

In order to ensure that you can effectively work with the legal staff, we have prepared a series of training documents on various areas of law and legal concepts that are generally encountered in your company's day-to-day operations. As an introduction to this training series, we will be outlining the common law tradition and sources of law. In this particular series we will be covering topics such as: what is common law, what are the sources of American law, what is the importance of precedent to the judicial decision-making process, and what are equitable and legal remedies?

The first topic we will cover is common law? Common law is a system of laws defined by previous court cases which set precedents for future cases. Judges have the authority to decide what the law is, when there is no other authoritative statement of the law. In other words, the legislature makes laws, and the judges interpret them. These interpretations become part of the law, and are used by judges in future cases.

Secondly, we will go over some sources of American law? Several sources of American law are but not limited to common law (case law), statutory law, administrative law, constitutional law, and court rules (otto-graph). Common law to start is the oldest form of law brought to the US from English colonists. Once a court makes a decision in a court case, they keep track of that resolution. And if another case comes up similar then the judge will more than likely make the same judgment in the new case based off the old one. This type of judgment is called precedent. The legislative branch is responsible for the creation of the statutory law. Administrative law is administered by federal, state and local governmental agencies (otto-graph). The Constitutional Law in a nutshell has the most impact on our society as a whole, and the Bill of Rights and Constitution are used to deliver this type of law....
