The legal article I have chosen is in regards to an investigation performed by the Office of Emergency Medical Services (OEMS). It’s on the regulatory issues of an EMT-B and an EMT-P. The Emergency Medical Technician and Paramedics are dispatched by 911 operators” (bls.gov). Where at times they may work with police officers or firefighters on the scene. “The New Jersey Department of Health and Senior Services is vested to carry out the provisions of New Jersey Statutes Annotated (N.J.S.A).

On the night of July 17th, 2005 the parents of a young boy found him on the floor in what they stated “was a full body seizure”. The boys parents called 911 and described him being blue in color, shaking all over with his eyes rolled back in his head, and foaming at the mouth (nj.gov/health).

The patient (boy) remained combative and incoherent, and yelling and swinging his arms. The EMT-B on site was Bennett who shouted at the patient and stated, “if he kept on striking him it was assaulting an officer”, and he would arrest him. EMT-P Giorgione had left the room to call the medical control through her cell phone.

While EMT-P was out of the room EMT-B Bennett “ordered the officers to handcuff him and make the handcuff tighter “(nj.gov/health)? A collar was applied to the patient since he continued to be combative.

EMT-B kept on yelling at the patient while in the ambulance accusing the patient of taking drugs and demanding him to tell him what type of drugs he took. Patient was handcuffed and no cops were in the ambulance they were just following the ambulance. As EMT-B Bennett continued to harass the patient and demanding the patient to tell him what he took, EMT-B was harassing the patient. Despite of the harassment the emergency room staff found no drugs to be in the patients system....
