Scenario:

On Saturday, Kurt e-mailed to Conrad to ask how much Conrad would sell his classic Ford Capri car for. Conrad replied later that day, stating that if he decided to sell, he would want 4000 pounds for it. Kurt immediately responded saying that he would like to buy the car and that he would collect it on Monday.

Conrad’s daughter Marlene accidentally deleted the email before Conrad had read it.

On Sunday Conrad took the Ford Capri to a classic car dealer and offered to sell it for 4000 pounds. The care dealer said he would consider the offer and contact Conrad if he decided to accept.

On Monday morning Conrad put an advertisement in the local newspaper that read, “A classic Ford Capri for sale. Perfect order. A really cool car! 4500 pounds. Ring Conrad on 345678”.

On Monday evening Susan left a message on Conrad’s answer-phone saying that she had seen the advertisement and would like to buy the car.

As Conrad listened to Susan’s message later that evening, Kurt arrived and told Conrad that he had come to collect the car. Conrad refused to hand the car over, stating that he had not agreed to the sale.

On Tuesday morning, Conrad received a letter from the car dealer that had been posted on Monday morning saying that he wished to purchase the car. Conrad immediately telephoned Susan to say that the car had already been sold.

Analyse the situation and advise the parties as to their rights and liabilities in the law of contract.
