Encroachment Map and Lok Adalat

Summary

India is a developing country. Most of cultivators live in villages. Agriculture is main occupation and wealth of the cultivators. Now a days the agriculturists are already worried about the bad Monsoon, Problems of Crops and its value / income. Like this, due to increase in population, Industrial Development, residential areas are increasing by converting land into Non-agricultural purpose therefore, the transaction to sale /purchase of land/ plot, is increasing. In both the cases, disputes about an encroachment are also increasing. Some are under title; Suit for removal of an encroachment, Suit for Injunction, or Suit for possession. Negligence or ignorance of legal knowledge at the sale transactions ,may be the reason for these suits. Therefore, while purchasing or selling lands/plots a basic enquiry is necessary.

Primary function of law or court is to keep peace. For the trial , there is a Procedural code. Now the amended Civil Procedure Code may curb the delay . So also, Lok Adalats are made for achieving the goal suggested under Legal Services Authorities Act, 1987.

Actually basic concept of such Lok Adalats is not new. We know our old Panch Committee. However, in such Panch committee there is no guarantee to compromise the matter in the legal form.

Lok Adalat is to determine and arrive at a compromise or settlement between the parties in a legal form. The whole idea to organize Lok Adalats is not an alternative system but it is supplementary system to the existing justice delivery system by resolving the disputes through conciliation and to leave sufficient time to the regular courts to attend the complicated matters.

Under Section 20 of Legal Services Authorities Act, 1987, Lok Adalat , can dispose of a matter by way of a compromise or settlement between the parties.
