Legal Terms

Administrative law- administrative laws are regulations, which say how to enforce that law, created by administrative agencies of the government.

Civil law- civil law handles the legal rights and relationships, such as torts and contracts, between individuals.

Burden of proof- the burden of proof is proving harm towards an individual.

Criminal law- criminal law is the crimes and punishments of an individual.

Statutory law- statutory law is passed by Congress, who can also amend, repeal, or expand the law.

Malpractice insurance- malpractice insurance, also known as medical liability insurance, pays the settlement amount and lawyer fees, from a lawsuit.

The Health Insurance Portability and Accountability Act (HIPPA)- HIPPA is used to protect health insurance coverage for workers and their families when they change jobs. It also used to protect the health care data integrity, availability, and confidentiality.

Privacy rule- privacy rule is to protect the individuals’ health information.

Protected health information (PHI)- information that is used to help identify an individual. The information used is name, address, phone numbers, date of birth, social security number, name of employer, Medicaid ID number and other medical record numbers.

Security rule- security rule is used to protect health information that is collected, used, transmitted, or maintained electronically.

Qualified protected order- qualified protected order forbids the use or disclosure of PHI for any reason and requires that the PHI and copies, to be returned to the covered entity or destroyed.

Emancipated minors- emancipated minors are individuals who are either married, living away from home and support themselves.

Tort- torts are wrongful acts which can bring a civil suit.

Contracts- contracts are legal agreements between two or more parties.
