Elements of a Crime

While each of the scenarios in this assignment are similar the difference among them are based on the intensity of the crime commited. Each case study shows Sarah wrongfully taking Makoto's laptop with the intent to deprive them of the property. The individual cases show elements detailing the acts allowing for a determination of what the crimes would be classified under law. The four primary elements of a crime are intent, conduct, concurrence and causation.

In the first case study Sarah commited the act of larceny. Larceny is a nonviolent act of taking or carrying away someone else's personal property (textbook). In a case of larceny, if the person knows who wrongfully took the property without athority they can sue under the tort law for tresspassing on personal property. There are two severities of larcey, grand larceny describes larger and higher valued possessions, where petty larceny is low valued smaller possessions.

In the second case study Sarah commited robbery. Sarah held Makoto at gunpoint to instill fear in order to obtain his laptop from his possession unwillingly. Dictionary.com defines robbery as a law that describes a felonious taking of the property of another from his or her person, in his or her immediate presence, against his or her will by violence or intimidation. (dictionary.com) Since Sarah held Makoto at gunpoint other charges would likely be filed along with robbery, such as aggravated assualt. Assualt is defined as placing another person in a potentially harmful situation, and no intent to cause physical harm needs to exisit. The assault would be elevated to aggravated assult simply because the use of a deadly weapon was involved. Again, along with the criminal factors to this case a lawsuit for tort can be claimed, there are various aspects that a lawsuit could be filed for, the assault and emotional distress.
