EXTRA INFORMATION ABOUT MKGT350 CASE STUDY ASSIGNMENT

Dear Students,

John Garrick has done a google search using ‘monkey selfie’ as search words. He reports that numerous media articles come up. He writes- ‘I have read some of the leading cover stories and believe there is ample scope for the students to write a good essay from various perspectives. For instance, they should be able to quickly identify who is the plaintiff (i.e. the professional photographer who believes he has been ripped off), various possible defendants (most notably the Wikipedia group who extensively used the photo).’ Students should identify the arguments of the plaintiff and indicate any possible legal authorities he might use to support his arguments; then they should analyse the defence arguments including what Wikipedia actually did, any possible ethical issues involved here and legal defences that would be available should the matter proceed to a trial. Students might also note the effects of the internet on copyright issues, breaches and possible enforcement problems across multiple jurisdictions. As the assignment question has an international flavour students should also ground some of their arguments in Australian copyright law e.g. how might this case interact with Australian law (for example, with the photo being published locally without permission, etc…) There are numerous other angles for the students to ‘get their teeth into’ (such as the intersection between legal rights and ethics).

Chris Sinclair makes some interesting observations in relation to the case study. She notes that there is quite a bit of legal commentary and related material on the issue of copyright (US, UK and Aust) and the ‘selfies’ (see also the ‘Degeneres Star selfie’) – the laws and public policy in a cyber-tech world: who is the author when the photos have been staged, photo-shopped, cropped, etc, are there multiple rights? lots to say and lots of scope to answer this interesting case (according to...
