Sexual Predator Prosecution in West Virginia

“West Virginia laws are very specific about sexual abuse and sexual assault. Sexual abuse occurs when a person subjects people to sexual contact without their consent, and that lack of consent is due to physical force, threat or intimidation. In West Virginia, sexual assault includes sexual intercourse and sexual intrusion,” (West Virginia Sex Offense Laws). WV has created statutes in which to battle sexual predators from offending within their municipals. This manner of offense is not accepted and the offender is severely penalized. The children of the state of WV is passionately defended and guarded against this type of offense. New statutes and procedures have been launched to fight sexual predator from injuring our children. WV’s statutes against rape or sexual abuses of an adult are correspondingly unforgiving, (West Virginia Sexually Violent Predator Management Task Force: Final Report).

WV has exceedingly little lenience for sexual crimes of any category. An offender who rapes a disinclined or debilitated female is alleged to have committed a first-degree felony, “W. VA. CODE § 61-8B-3 Sexual assault, first degree requires sexual intercourse or sexual intrusion,” (RAINN), Sodomy is also a first-degree felony in WV, (West Virginia Sex Offense Laws). These laws have been created and followed for several years. WV has continually had unsympathetic laws and statutes regarding the offense of sexual assault, torture, or forcible rape.

WV has also adopted Megan’s Law. President Clinton endorsed Megan’s Law, which deals with sex offenders and molesters of children, on May 17, 1996. Megan’s law was greatly essential, in spite of Washington State's 1990 Community Protection Act, which consisted of America's first law sanctioning public notification when dangerous sexual predators are released from a correctional facility back into a community.
